We will also keep a copy of each order! .
All Orders are handled on a first in, first out basis. If we have problems with any of our services we will do all we can to correct the problem, and email our customers with the estimated time for the problem to be corrrected.
Pursuant to this Agreement, Affiliate Marketing Express of 14 Scheu Park, Buffalo, NY 14211, and its "Clients" shall agree to the following terms and conditions.
1.) Order Tracking / Statistics provided by Affiliate Marketing Express is final and binding. We are not responsible for member counts being off if your site has been inoperative and signups cannot be redirected to a different URL (for any reason). Upon completion of your signups order (not realtime) you will be emailed your signups record including IP, date and time stamp.
2.) Affiliate Marketing Express is not liable to replace duplicate records in the client's database. A person may signup for similar offers at different websites and at different times.
3.) Affiliate Marketing Express will supply a client with 10% additional leads to cover for possible invalid and duplicate leads. Under no circumstances can a client demand any additional compensation/refund for duplicate leads. However, if invalid telephone numbers and invalid email addresses exceed 10% of the order quantity, then Affiliate Marketing Express will replace the invalid leads. After this replacement, Affiliate Marketing Express will not be liable for any further replacements.
4.) Affiliate Marketing Express will make every effort to fulfill an order within 7 business days after order placement. However, Affiliate Marketing Express may take up to 30 business days to completely fulfill an order.
5.) Affiliate Marketing Express will only refund if we cannot generate the amount of signups/leads that you order. All leads/signups are kept in spreadsheet form so we know what has been entered into your site.
6.) An order can be cancelled up to 24 hours after payment is received. After that point the funds have already been put into generating the signups/leads/traffic for your order.
7.) ** We CANNOT take companies that require a social security or credit card number or consist of adult material (upgraded signups excluded - but still not adult)
8.) Affiliae Marketing Express will input your signups into your program only one time. If some or all of the signups fail to show in the system it is due to programming error or ip blocks on the site. We will send you an attachment with the contact information of your signups so that you can contact the ones that do not show in the system. Companies with IP blocks will have to handle the same as the above this rule includes site where it requires the signup to double optin. As our signups are not incentivized they will only double optin if they are truly interested. You can encourage this by contacting your signups.
9.) For some signups you will receive your signups via Real Time Delivery - When using realtime delivery the charge is for raw data only meaning that because the data is getting delivered real time we have no concept of what is going into the system. Duplicates, bad emails, bogus signups can all happen easily with this method. We will give 10% extra on orders to cover this issue. We will replace any bad phone numbers.
10.) Subscription payments - If you choose to cancel your monthly subscription you must do so prior to that billing period in order not to be charged.
11.) Affiliate Marketing Express does not guarantee any percentage of upgrades. These signups are to be considered leads that may or may not decide to actually participate in your program. Many of our clients report upgrades from our leads (signups).
12.) In the event that the Do Not Call law should be in effect you, the client, understands that it is your responsibility to scrub your leads against the Do Not Call List prior to contacting your leads/signups. Failure to follow this procedure my result in heavy fines. Affiliate Marketing Express will not assume any liability in this situation.
13.) In no event shall either party be liable for special, indirect, incidental, or consequential damages, including, but not limited to, loss of use, or loss of profits.
14.) Affiliate Marketing Express reserves the right to terminate this agreement anytime, with or without cause. Termination notice may be provided via email or any other public means and will be effective immediately.
15.) Unpaid orders are subject to a 1.5% monthly surcharge and the Client is also liable to pay any and all legal/attorney fees which was required to recover the payment.
16.) The relationship between Affiliate Marketing Express and the Client will be governed by, and construed in accordance with, the laws of the State of New York. Client hereby irrevocably consents to the exclusive jurisdiction of the courts of the State of New York and the federal courts situated in the State of New York in connection with any action arising between the parties.
17.) If any of the terms are held unenforceable, the reminder of the terms shall remain in effect.
18.) By agreeing to this Agreement, the Client warrants that Client (or Authorized Representative of the Client) is at least 18 years of age, and that and that there is no legal reason that Client cannot enter into a binding contract.
Special Circumstances for:
1. Premium Signups:
REFUNDS are issued only if we cannot produce the amount of Signups Ordered. Refunds for Premium and Upgraded Signups are Pro-rated.
2. Targeted Visitors/Raw Visits
Targeted Visitors URLS CANNOT have POP UP ADS connected to the link. Please ensure your link does not have pop up ads. Refunds are also made only if the number of visits is not met for both Targeted and Raw Visits with a 30 to 60 day
guarantee depending on Order Size.
3. Phone Center Leads - (Post Called)
We do NOT GUARANTEE anybody called will upgrade in your program. WE do guarantee that we will attempt 3x's to contact everyone on the list, and leave messages each time if there is voice mail or an answering machine available. We do our BEST to have them contact the buyer of the Phone Center Lead Package.
4. Guaranteed Signups - (BASICS)
As stated, we will get you the quanity ordered. We cannot guarantee a timeframe for this service. Your orders can take from a day to a year or longer, depending upon the order size, quality of the program, and so forth.
5. Other Services
All services are as advertised.
NO CALL LIST - REPEATED
Affiliate Marketing Express Does not take responsibility to any issues that may arise while calling any purchased leads. Affiliate Marketing Express will provide the timestamp and DSN No. for your convience in dealing with any complaints that may arise from the person called.
Affiliate Marketing Express is NOT RESPONSIBLE for any leads that were passed to our customers that may have been on the NO CALL List. Buy and Call all leads from Affiliate Marketing Express at your own risk.
IF a Refund is requested for any serivce, the Refund will only be issued on a case by case basis. Allow 48 to 72 hours for any Authorized Refunds.
